This property damage action was tried by the Court without a jury on April 14th and 15th, 2005. The action arises out of an agreement entered into between plaintiff, a law firm, and defendant, a moving company, whereby defendant agreed to transport plaintiffs office equipment, boxes, furniture, and supplies from its location at 31 Smith Street in Brooklyn to its new location at 26 Court Street in Brooklyn on December 27, 2003. The basis of plaintiffs complaint is the damage to its copier, which both parties agree was rendered inoperable beyond repair.
